Often, insurance companies will issue a letter to the other party stating the party needs to mitigate their damages. This is a tactic insurance companies use to minimize their responsibility for towing and storage fees. Essentially, after a wreck in Alabama, while an insurance company is investigating a claim, the insurance company does not want to be responsible for the storage that accrues at the tow lot as each day passes. So, they may send a letter to the other party telling them to mitigate their damages. At this point, it is argued that you have a duty to have the car removed from storage. If you fail to do so, there is an argument supported by Alabama law that the insurance company will not be responsible for the storage that accrued after you received the letter.
